Although it’s federally accepted, the reason that people are confused about its legal status is because of the U.S.’s controversial relationship with cannabis.

How Delta-8 Became Legal

As we know, the use of marijuana for both recreational and medicinal use is becoming more accepted throughout the country. That being said, although some states have legalized it, marijuana is still considered a Schedule I drug on a federal level. This means that it’s considered a high risk for abuse and currently has no medical use.

Since Delta-8 derives from hemp, and it wasn’t mentioned in the bill, it also became legal to sell.  Since then, the industry has boomed and you can now find Delta-8 all over the United States.
