The cannabis plant was once something that had a bad reputation. Thanks to research, though, we now know that it has a wide range of benefits. Although it’s growing in popularity, some people don’t understand if it’s legal at the federal level.

Is Delta-8 Legal?

This is the big question that everyone wants to know. On a federal level, Delta-8 is legal if it’s derived from hemp. This means that you can enjoy your favorite Delta-8 products without having to worry.

Although it’s federally accepted, the reason that people are confused about its legal status is because of the U.S.’s controversial relationship with cannabis.

How Delta-8 Became Legal

As we know, the use of marijuana for both recreational and medicinal use is becoming more accepted throughout the country. That being said, although some states have legalized it, marijuana is still considered a Schedule I drug on a federal level. This means that it’s considered a high risk for abuse and currently has no medical use.

So, what does marijuana laws have to do with Delta-8? Well, of course, these are two different things, but they derive from the same plant. As a result, the legality of the plant’s compounds, such as Delta-8, can cause confusion among new consumers.

To better understand when it became legal, we have to go back to 2018, when the Farm Bill legalized hemp. Since Delta-8 derives from hemp, and it wasn’t mentioned in the bill, it also became legal to sell.  Since then, the industry has boomed and you can now find Delta-8 all over the United States.
